1. Agreement to terms
By accessing or using PixelPrompt at imageprompt.cloud ("the Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. These Terms are governed by the laws of England and Wales.
2. Description of service
PixelPrompt is an AI-powered tool that converts uploaded images into text prompts optimised for AI image generators including Midjourney, Flux, Stable Diffusion, and others. The Service is provided on a subscription basis with a limited free tier.
3. Eligibility
You must be at least 18 years old to use PixelPrompt. By using the Service, you confirm that you meet this requirement and that the information you provide is accurate.
4. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorised use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in abuse, or are used for fraudulent purposes.
5. Subscriptions and billing
Paid plans are billed monthly on a recurring basis from the date of subscription. Your usage resets on your billing anniversary date each month.
Payments are processed securely by Lemon Squeezy (lemonsqueezy.com), our authorised payment processor.
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of the current billing period. No refund is issued for unused time in the current period. You retain full access to your paid plan until the period ends.
We reserve the right to change pricing with 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.
6. Acceptable use
You agree not to use PixelPrompt to:
- Upload images containing illegal content, including child sexual abuse material (CSAM)
- Upload images depicting non-consensual intimate imagery
- Infringe third-party intellectual property rights
- Attempt to reverse-engineer, scrape, or abuse the Service
- Circumvent usage limits or access controls
- Use the Service for any unlawful purpose under UK law
We reserve the right to terminate accounts that violate these rules without notice or refund.
7. Intellectual property
You retain all rights to the images you upload. The prompts generated by the Service based on your images are yours to use freely, including for commercial purposes on paid plans.
The PixelPrompt platform, branding, code, and design are owned by PixelPrompt and may not be copied, reproduced, or distributed without written permission.
8. Disclaimer of warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or that generated prompts will meet your specific requirements.
AI-generated outputs may occasionally be inaccurate, incomplete, or unsuitable. You are responsible for reviewing and using any generated content appropriately.
9. Limitation of liability
To the maximum extent permitted by English law, PixelPrompt shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you shall not exceed the amount you paid us in the three months preceding the claim.
10. Service availability
We aim to maintain high availability but do not guarantee uptime. We may perform maintenance, introduce changes, or temporarily suspend the Service without notice. We are not liable for any loss resulting from downtime or service interruptions.
11. Termination
You may delete your account at any time. We may suspend or terminate your access if you breach these Terms. Upon termination, your right to use the Service ceases immediately. Provisions relating to intellectual property, liability, and governing law survive termination.
12. Changes to these terms
We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice on the website. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
13. Governing law and disputes
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
